Terms and Conditions

These terms and conditions contain important information about your rights and obligations when you subscribe for a package on our website. You should seek independent legal advice before subscribing if you have any questions about the meaning and effect of any of these terms and conditions.

By subscribing for a package, you accept that a contract is formed between you and us on the terms and conditions set out below:

Definitions

In these terms and conditions:

  • "we", "our", "us" refers to Space Hero Pty Ltd ACN 128 156 409;
  • "you", "your", refers to you as a subscriber for a package;
  • "our website" or "the website" refers to spacehero.com.au which is operated by us;
  • "package" means a listing package and a video package or either of them;
  • "listing package" means a Diamond package, a Platinum package, a Gold package or an Express package, as described on our website;
  • "video package" means a 2.5 minute video or a one minute video, as described on our website;
  • "order form" means the form setting out the details of your subscription for a package.

Subscriptions

You may subscribe for a package by completing and submitting an order form online on our website. The current cost of the package for which you subscribe is shown in the order form.

Upon receipt of your order form, we will send you a tax invoice confirming the details of your subscription and methods of payment.

Term

The term of this contract is for a period of 3, 6 or 12 months commencing on the date that your property is listed on our website. You acknowledge that no refund is payable in the event that you request us to remove the listing of your property on our website within the 3, 6 or 12 month period.

Your Obligations

You acknowledge and agree that:

  • you must obtain our written consent before making any reference to us or our website in any of your promotional or merchandising material;
  • you must ensure that the information you provide to us for uploading on to our website is accurate in all respects and not unlawful, defamatory, misleading or deceptive or in breach of copyright;
  • by subscribing for a package, you grant us a non-revocable licence without charge to use in any way we determine (including for our commercial purposes) any of the information you provide to us in subscribing for a package;
  • we may contact you periodically via email or other electronic media to inform you of products and services we have on offer;
  • we may refuse to accept any material you provide for uploading on to our website if we determine, in our absolute discretion, that the material is unlawful, defamatory, misleading or deceptive, in breach of copyright or otherwise of such a nature as would expose us to liability or legal proceedings;
  • we do not control the activities of users of our website and you agree that we are not liable or responsible in any way for the activities or behaviour of users of our website;
  • access to information about your property on our website may periodically be affected by factors beyond our reasonable control such as interruption to internet services, failure of electricity supply and computer viruses;
  • we retain ownership of all media (including photographs and videos) we provide as part of the package for which you subscribe and such media must not be used on any other website or in any other way whatsoever without our prior written permission.

Termination

We may terminate this contract or remove details of your property if you breach any of these terms and conditions.

Limitation of Liability

To the extent permitted by law, we exclude all conditions and warranties relating to your listing on our website that are not expressly set out in these terms and conditions. To the extent that our liability for breach of any implied warranty or condition cannot be excluded by law, our liability will be limited at our option to resupplying the package.

Under no circumstances will we be liable to you for any indirect, incidental, special and/or consequential losses or damages (including but not limited to loss of profits, income, production, goodwill, data or opportunity) howsoever arising in connection with your listing on our website.

Indemnity

You agree to fully indemnify and hold us harmless against any expenses, costs, loss (including consequential loss) or damage we may suffer or incur as a result of or in connection with your listing on, access to or conduct in connection with our website, including any breach by you of these terms and conditions.

General

If any provision of this contract is invalid, illegal or unenforceable, then to the extent of the invalidity, illegality or unenforceability, that provision shall not affect the validity of the remaining provisions of the contract, which shall remain in full force and effect.

This contract contains the entire agreement between the parties on the subject matter.

This contract is governed by the laws in force in Queensland, Australia. You agree to the non-exclusive jurisdiction of the courts of Queensland, Australia and any courts which may hear appeals from those courts in respect of any proceedings in connection with this contract.

Payments

All final payments are in Australian Dollsrs ($AUD) and are GST inclusive unless otherwise noted.

Delivery

Once payment is made, Space Hero will contact you to arrange/complete the work on your properties listing.
